By using EverDomaining.com (the "Site") you agree to these Terms of Service. If you do not agree, please do not use the Site.

1. Nature of service

EverDomaining is a domain-name brokerage. The Site displays domain names available for sale and links buyers to third-party registrars where the actual purchase is completed. We do not process payments on this Site. Every transaction is subject to the terms and conditions of the registrar you choose (GoDaddy, Sedo, Atom, Spaceship, Dynadot or Unstoppable Domains).

2. Listings and pricing

Prices, availability, and domain attributes are subject to change without notice. Displayed prices are indicative until confirmed at the registrar's checkout. A listing does not constitute a binding offer.

3. Third-party registrars

Payment, escrow, KYC, refunds, and transfer are governed by the registrar you select. We are not responsible for their availability, pricing, or dispute resolution.

4. Prohibited use

• Scraping or automated access without written permission.
• Attempting to bypass registrar checkout to avoid escrow protection.
• Submitting fraudulent inquiries, offers, or listings.
• Interfering with the Site's operation or security.

5. Intellectual property

All content on this Site - including copy, layout, branding, and code - is the property of EverDomaining unless otherwise indicated. Registrar names and logos remain the property of their respective owners and are used to identify the checkout destinations.

6. Disclaimers

The Site is provided "as is." We do not warrant that any specific domain will be available, that its price will not change, or that the Site will be free of errors or interruptions.

7. Limitation of liability

To the maximum extent permitted by law, EverDomaining is not liable for any indirect, consequential, or incidental damages arising from your use of the Site. Our aggregate liability for direct damages is capped at the brokerage fee we would have earned on the relevant transaction (if any) or €100, whichever is higher.

8. Indemnity

You agree to indemnify and hold EverDomaining harmless from claims arising from your breach of these Terms or your misuse of the Site.

9. Changes

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the new Terms.

10. Governing law

These Terms are governed by the laws of FR. Disputes will be brought before the competent courts of Paris, unless a mandatory consumer-protection law requires otherwise.
